Melissa Rivers Files Malpractice Lawsuit After Joan Rivers’ Death
Melissa Rivers has filed a lawsuit for malpractice after the death of her mother, Joan Rivers.
The comedian died in September at 81 after a lack of oxygen caused irreparable brain damage during a procedure on her throat at a Yorkville Endoscopy clinic.
“The level of medical mismanagement, incompetency, disrespect and outrageous behavior is shocking and frankly, almost incomprehensible, ” Melissa said in a statement, according to USA Today.
The doctors at the clinic are accused of snapping a photo of Joan while she was lying unconscious, and one of Melissa’s lawyers, Ben Rubinowitz, said that while they were taking a picture, they were ignoring the emergency.
“The conduct is unfortunately outrageous,” Rubinowitz said. “Not only is there medical mismanagement but you have a situation where doctors are taking photos of a patient when she needed assistance. They didn’t recognize the fact that she wasn’t getting sufficient oxygen.”
Melissa said that filing the lawsuit is one of the hardest things she has done, but felt like it was necessary, so other people don’t have to suffer the same way.
“What ultimately guided me was my unwavering belief that no family should ever have to go through what my mother, Cooper and I have been through,” she said, referring to her son. “It is my goal to make sure that this kind of horrific medical treatment never happens to anyone again.”
A federal investigation found several errors in the practice, including the cellphone picture taken and failure to keep current records of the patient during the procedure.
